FIDLEG (engl. FinSA) sets out cross-sector rules for offering financial services and distributing financial instruments. The rules are aligned with the EU directives (MiFID II, Prospectus Directive, PRIIPs). However, FIDLEG includes important adjustments made to reflect the specific Swiss circumstances. Institutions that did not implement MiFID II will have to battle with new requirements facing their clients based in and served our of Switzerland. For all the others, there are good opportunities to leverage work already done or take advantage of some of the differences. However, it all takes time.

With only very limited time to complete the implementation, we believe that financial institutions should learn from the MIFID II implementation. In particular, common pitfalls can be avoided to increase efficiency for regulatory compliance and to ensure a more complete implementation by the regulatory deadline (i.e. avoiding “Day 2” activities).

In this webinar, we will provide insights into the FIDLEG regulation following the expected publication of the ordinance in late October. Further, our Deloitte experts will lead participants through the major gaps between FIDLEG vs. MiFID II and outline a potential approach for the implementation of this regulation. Hartmut is responsible for Deloitte’s Regulatory & Risk Assurance Services in Zurich. He has substantial experience working with Swiss and international banking groups and asset managers. He is a member of the NWE Steering Committee and the European Working Group of Deloitte’s EMEA Centre for Regulatory Strategy. Hartmut focuses on regulatory aspects of legal entity transformations as well as regulatory change with a strong focus on universal banks and asset managers. Prior to joining Deloitte, Hartmut has served as general counsel on the executive board of the asset management arm of the third largest Swiss banking group.
